Echoholics Records respects the intellectual property rights of others and expects the same from everyone who uses our site — including anyone who submits content, uploads music, or leaves reviews.

This page explains how to report a copyright concern, and how we respond.

Reporting infringement

If you believe content on echoholics.com infringes your copyright, send a written notice to our designated agent that includes all of the following. Under U.S. law (17 U.S.C. § 512(c)(3)), a notice missing any of these may not be considered valid:

  1. Your physical or electronic signature (typed name is sufficient)
  2. Identification of the copyrighted work you claim is infringed
  3. Identification of the material you claim is infringing, and where to find it on our site (a URL is ideal)
  4. Your contact information — address, phone number, and email
  5. A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law
  6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf

Notices missing required information may not receive a response.

What happens after a valid notice

We’ll remove or disable access to the material identified, and make a good-faith effort to notify the person who posted or uploaded it.

Counter-notification

If your content was removed and you believe that was a mistake — you have the rights to use it, or it was misidentified — you can send a counter-notice with:

  1. Your physical or electronic signature
  2. Identification of the material removed and where it was located before removal
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed by mistake or misidentification
  4. Your name, address, and phone number
  5. A statement that you consent to the jurisdiction of the federal court in your district (or, if outside the US, any district where Echoholics Records may be found), and that you’ll accept service of process from the person who filed the original notice

If we receive a valid counter-notice, we may restore the material within 10–14 business days, unless the original notifier informs us they’ve filed a court action.

False claims

Don’t file a notice you know to be false. Under U.S. law, knowingly misrepresenting that material is infringing can make you liable for damages, including legal fees, incurred by the person you accused.

Repeat infringers

We terminate accounts belonging to users who repeatedly upload or submit infringing material, in appropriate circumstances.

Content submitted to us

Everything uploaded to Echoholics — demos, assets, reviews, and anything else — must be either your own original work or something you have the rights to submit. Submitting infringing material may result in removal of the content and suspension of your account. See our Demo Submission Terms for more.

Sampling. If your submission uses a sample, you’re responsible for having cleared it, or for confirming it’s from a source licensed for the use you’re making of it (including many royalty-free packs, which still carry their own terms). We may ask for that confirmation before releasing anything that includes a sample.

Our own content

Everything we publish — music, artwork, video, and site content not otherwise credited — is owned by Echoholics Records or used under license. Unauthorized copying, redistribution, or commercial use is not permitted. See our Terms & Conditions and Beat & Sound Licensing Terms for what license terms actually apply to things we sell.
